NXTG.AI Terms of Service

The Short Version
NXTG.AI builds local-first, open-source developer tools. Use them however you want, subject to their respective open-source licenses. Do not use them for anything illegal. We provide them "as is" with no warranty.
1. Agreement
These Terms of Service ("Terms") govern your use of products and services provided by NXTG.AI ("we," "our," or "us"), including our developer tools, data intelligence products, and the nxtg.ai website (collectively, the "Services").
By using our Services, you agree to these Terms. If you do not agree, do not use our Services.
2. Our Products
2.1 Open-Source Developer Tools
Our developer tools are open-source software released under OSI-approved licenses:
- Forge (Claude Code plugin) and Forge Orchestrator (task engine) are released under the MIT License.
- Faultline Pro (AI claim forensics CLI) is released under the Apache License 2.0.
You are free to use, copy, modify, and distribute these tools subject to the conditions of their respective licenses. The full license text is included in each source code repository.
These tools run locally on your machine. Core functionality requires no hosted service, no account, and no subscription.
2.2 Faultline Pro
Faultline Pro provides forensic verification of AI-generated claims, including EU AI Act risk classification and compliance report generation. Key terms specific to Faultline Pro:
- Telemetry: Faultline Pro offers optional, anonymized usage telemetry. It is disabled by default and activated only by setting
FAULTLINE_TELEMETRY=1. See our Privacy Policy for full details on what is collected. - AI providers: Faultline Pro integrates with third-party AI providers (Google Gemini, OpenAI, Anthropic Claude, Perplexity). Your use of these providers is subject to their respective terms. We do not store, process, or have access to the content you submit to these providers.
- Compliance reports: EU AI Act risk classification and compliance reports generated by Faultline Pro are informational tools. They do not constitute legal advice, regulatory certification, or a guarantee of compliance with any regulation. You are responsible for your own compliance obligations.
- License: The CLI, telemetry module, and telemetry worker are all Apache-2.0 licensed.
2.3 Paid Tiers (Future)
We may introduce paid subscription tiers for certain products. When launched, paid tiers will have their own supplementary commercial terms clearly stated on the relevant product and pricing pages. Open-source core functionality will remain available under the existing open-source licenses.
2.4 nxtg.ai Website
The nxtg.ai website provides documentation, product information, and resources. It is hosted on Vercel.
3. Licenses
3.1 Open-Source Software
Our developer tools are released under OSI-approved open-source licenses:
- MIT License — Forge, Forge Orchestrator, and associated tools. Grants broad rights to use, modify, and distribute with minimal restrictions.
- Apache License 2.0 — Faultline Pro CLI, telemetry module, and telemetry worker. Grants broad rights to use, modify, and distribute, with patent grant and attribution requirements.
The applicable license for each product is specified in its source code repository.
3.2 Website Content
Content on the nxtg.ai website (text, images, design, marketing copy) is copyrighted by NXTG.AI. You may not reproduce, distribute, or create derivative works from our website content without permission, except as permitted by fair use.
3.3 Trademarks
"NXTG.AI," "Forge," "Faultline," "Faultline Pro," and associated logos are trademarks of NXTG.AI. Open-source licenses do not grant permission to use our trademarks. You may refer to our products by name for accurate description (e.g., "built with Forge," "verified by Faultline"), but you may not imply endorsement or affiliation without permission.
4. Acceptable Use
You agree not to use our Services to:
- Violate any applicable law or regulation
- Infringe upon intellectual property rights of others
- Distribute malware or malicious code
- Misrepresent your affiliation with NXTG.AI
- Use our trademarks in a misleading manner
- Abuse our community spaces (GitHub issues, discussions) with spam or harassment
- Submit false or misleading data to our telemetry endpoints
- Attempt to reverse-engineer, de-anonymize, or correlate telemetry data to identify individual users
Since our developer tools are open-source and run locally, we do not monitor or restrict how you use the software itself. These restrictions apply to your interactions with our website, community, hosted services, and brand.
5. Third-Party Platforms
Some of our tools integrate with third-party platforms:
- Forge is a plugin for Anthropic's Claude Code
- Faultline Pro integrates with Google Gemini, OpenAI, Anthropic Claude, and Perplexity
- Telemetry processing uses Cloudflare Workers and Cloudflare D1
Your use of third-party platforms is governed by their respective terms of service. We are not responsible for the availability, performance, or behavior of third-party services. We provide tools that work within their ecosystems but do not control them.
6. EU AI Act
Faultline Pro includes features designed to help users assess AI outputs against EU AI Act risk tiers. These features:
- Are informational and advisory — not legal, regulatory, or compliance guarantees
- Reflect our interpretation of published EU AI Act requirements as of the date of the software release
- May not reflect subsequent regulatory guidance, amendments, or enforcement decisions
- Do not substitute for professional legal counsel
We make reasonable efforts to keep our risk classification logic current with published regulatory guidance, but we do not warrant its completeness or accuracy for any specific compliance use case.
7. No Warranty
Our software is provided "as is," without warranty of any kind, express or implied. This includes, without limitation, warranties of merchantability, fitness for a particular purpose, and non-infringement.
Specifically:
- Health scores, security scans, and governance assessments produced by our tools are advisory — they do not replace professional code review, security audits, or compliance assessments
- AI claim verification results, risk scores, and compliance reports are informational — they do not constitute legal or regulatory advice
- We do not guarantee compatibility with all versions of third-party platforms
- We do not guarantee uninterrupted availability of our website or online resources
- AI-assisted features depend on third-party AI providers and are subject to their limitations
8. Limitation of Liability
To the maximum extent permitted by law, NXTG.AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Services, including damages for loss of profits, data, or other intangible losses.
Since our tools run locally on your machine, you are responsible for your own data backups, system security, and development practices.
9. Indemnification
You agree to indemnify and hold harmless NXTG.AI from any claims, damages, or expenses arising from your use of our Services or violation of these Terms.
10. Contributions
If you contribute code to our open-source repositories (via pull requests, patches, or other means), you agree that your contributions are licensed under the same license as the project (MIT for Forge ecosystem, Apache-2.0 for Faultline Pro). You retain copyright to your contributions.
11. Support
Our open-source tools are community-supported. We provide support through:
- GitHub Issues on each product's repository
- Documentation on our website and in repositories
We do not currently offer guaranteed response times or paid support plans. This may change as our products mature.
12. Changes to These Terms
We may update these Terms when we release new products or change our practices. Updated Terms will be posted on this page with a new "Last Updated" date. Your continued use of our Services after changes constitutes acceptance.
For material changes, we will make reasonable efforts to notify users through our repositories or website.
13. Termination
Our open-source tools run locally — there is nothing for us to remotely terminate. You can stop using any tool by uninstalling it.
We reserve the right to restrict access to our website, online resources, or community spaces in cases of abuse.
For future products that involve hosted services, specific termination terms will be stated in their product-specific sections.
14. Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of Delaware.
15. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
16. Entire Agreement
These Terms, together with our Privacy Policy and any product-specific terms, constitute the entire agreement between you and NXTG.AI regarding our Services.
